Requirements :

  • LLB degree or a four (4) year Legal qualification at NQF level 7 as recognized by SAQA. A minimum of 8 years’ post qualification experience, of which 5 years should be at middle management level (Deputy Director/MR-6) within a legal environment. An admission as an Advocate or Attorney will be an added advantage. A valid Driver’s Licence. Knowledge of the public sector regulatory framework, especially the Public Sector Supply Chain Management and Public Service Act and Regulations. Problem solving and decision-making skills. Excellent written, verbal communication and presentation skills. Computer literacy (Word, Excel and Power-Point). Ability to work independently and under pressure. Planning and organizing skills. Analytical legal thinking, strong leadership, people and general management skills.

Duties :

  • The incumbent will be responsible to provide leadership and strategic direction in the provision of legal services, legal opinions and ensuring compliance with the requirements of chapter 10 of the constitution and health legislations in the execution of the mandate of the GDoH to the other external departments. To provide sound, well-researched and professional legal advice and support to the department, in respect of matters of interpretation and/or implementation that may arise. Determine, drafting and reviewing of the legislation, rules and policies administered by the GDOH including Contract and MoU drafting and Review. Strategic formulation of legal policies through analytical and innovative thinking, interpretation and implementation of policies. Legal vetting of departmental policies. Develop and review the risk management in respect of the GDOH commercial and operational contracts, agreements and Memorandum of Understanding. Determine, lead, manage, and coordinate potential litigation matters requiring strategic investigations for the GDOH. Lead and liaise within the GDOH and the various Offices of the Chief State Law Advisor, Private Attorneys, Advocate, Office of the State Attorney and other Consultants on investigations, legal opinions and on all litigious matters. Respond to all queries received from other external stakeholders on legal compliance risk matters. Developing and maintaining proper corporate interactions with the relevant stakeholders such as parliament, other departments across all spheres of government, state Attorneys, State Law Advisors, chapter nine institutions, universities, AG and other institutions of higher learning. Facilitation and reporting on the requests for information by the various oversight bodies and responding to information queries. Assist with other delegated functions from the Accounting Offer and Executive Authority. Provide leadership to the HR component, labour relations and legal advice on HR and labour relation issues. Advice on financial matters of the organisation requiring legislative / legal compliance. Determine, set, direct and account for strategic partnerships and relationships management in respect of the Access to Information Manual Section 15, 14 and 31 and coordinate legal request for Access to information in line with PAJA and POPI Act. Determine, set, direct and account for strategic partnerships, relationships management, information communication with stakeholders, Communications technology and documents management in the provision of legal services and litigation management to the organisation. Managing a team of lawyers across the organisation / legal forum guidance and support as may be required, as well as identification of training for all staff within the Legal environment or Legal forum from time to time. Provide advices, lead and manage or support of GDOH Grievance and Complaint management of high level cases or as may be necessary in conducting investigations, provision of legal opinions or review of cases and reports. Collate inputs from the various GDOH officers, both at Head Office and in the provincial offices and compile the annual audit report, at financial year-end in relation to the directorate. Respond to all queries received from other external stakeholders on legal compliance risk matters. Effective and efficient management of financial, physical, human resources requirements in the provision of legal services to the organisation. Effectively manage human and financial resources in compliance with the applicable regulatory framework. Establish and maintain appropriate internal controls and reporting systems to provide monthly, quarterly and annual reports and ensure timeous submission thereof in compliance with the applicable requirements.
