Requirements :

  • A grade 12 Certificate, an appropriate LLB Degree or recognized 4-year legal qualification (NQF 7). Admission of the High Court South Africa or Advocate. Five (5) years’ experience at a senior management level. Accredited mediator with a proven record of successful mediating Medico Legal Cases. Knowledge of all spheres of law including drafting, litigation, negotiating drafting, scrutiny of agreements, opinion writing, subordinate legislation, management and budgeting. Knowledge the Constitution of the Republic of South Africa, 1996 and legislations, related regulations and policies in the public health sector. A valid Driver’s licence (with exception of persons with disabilities). Computer literacy. Competencies: Strategic capability and leadership, Programme and Project Management, Financial Management, Change Management, People Management and Empowerment. Service delivery innovation, Problem solving and analysis, Communication, Client orientation and customer focus.

Duties :

  • The successful candidate will be required to provide legal guidance and support to the entire department. Advise the MEC, Senior Management, and staff on all legal matters to manage and mitigate legal risks that might face the department. Oversee and manage the delivery of legal services (including litigations and medicolegal cases) to the Department. Oversee and manage Agreements as requested by management in the Department. Offer legal opinions and advice by advising MEC on appeals lodged against administrative decisions taken in terms of legislation guiding the department. Oversee, manage and direct development, evaluation and assessment of draft legislation. Oversee and manage the translation of legislation. Facilitate and manage stakeholder relations. Manage the human and financial resources of the Chief Directorate as delegated. Consulting with experts on the relevant fields of law and advising on settlement to avoid unnecessary legal costs. Monitor Legal Contracts by scrutinizing agreements and comply with prescribed procedure for the conclusion of binding documents, identifying the intention of the contract and provide legal advice during conceptualization of the contract, conducting risk assessment to avoid unnecessary financial loss and litigation. Consult with staff and external parties involved in the contract. Consulting with State Law Advisors on contracts. Communicate with State Attorney on litigation matters involving the department by managing the investigation and compiling relevant documents to State Attorney.

Candidates in possession of a foreign qualification must furnish the Department with an evaluation certificate from the South African Qualifications Authority (SAQA). The performance of normal and commuted overtime, where applicable is not mandatory, however it will be based on the operational needs of the hospitals.
